1. Who We Are

TheBJJ.app is operated by an individual entrepreneur (autónomo) based in Spain. In accordance with Spanish Law 34/2002 (LSSI-CE), Article 10:

2. What the Service Does

TheBJJ.app is a digital tool for Brazilian Jiu-Jitsu practitioners to:

• Log and organise techniques, positions, and concepts
• Record sparring sessions (rolls) with notes and outcomes
• Track training partners and their details
• Set and monitor training goals and progress
• Analyse training data for personal insights

3. Accounts

To use TheBJJ.app you must create an account with a valid email address and password. By creating an account you confirm that:

• You are at least 16 years old
• The information you provide is accurate
• You will keep your login credentials secure
• You are responsible for all activity under your account

4. Free and Paid Plans

Free Tier

The free plan provides core functionality with usage limits. You can use the free tier indefinitely at no cost.

Pro Plan

The Pro plan removes limits and unlocks additional features. It is available as a monthly or annual subscription.

Lifetime Plan

The Lifetime plan is available as a one-time purchase. It grants access to all Pro features indefinitely, with no recurring charges. Lifetime spots are limited and may not be available at all times.

5. Your Data and Content

You retain full ownership of all content and data you enter into TheBJJ.app. By using the service, you grant us a limited licence to store, process, and display your data solely for the purpose of providing the service to you.

• You can export your data at any time (Pro feature)
• You can delete your data and account at any time from Settings
• We never sell, rent, or share your data with third parties for marketing

6. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to access other users' accounts or data
• Interfere with or disrupt the service or its infrastructure
• Upload malicious code, spam, or harmful content
• Use automated tools to scrape or extract data from the service
• Resell, sublicence, or commercially exploit the service without permission

7. Intellectual Property

The TheBJJ.app name, logo, design, code, and all original content are our intellectual property and are protected by applicable copyright and trademark laws.

Your training data and content remain yours. Our intellectual property rights do not extend to the content you create and store on the platform.

8. Availability and Changes

We strive to keep TheBJJ.app available and reliable, but we cannot guarantee uninterrupted access. We may:

• Perform maintenance that temporarily affects availability
• Update, modify, or improve features over time
• Discontinue features with reasonable notice

In compliance with EU Directive 2019/770 (Digital Content Directive), we will ensure that the digital content remains in conformity with the contract for as long as you have an active subscription. If updates materially reduce functionality, you may be entitled to a remedy.

9. Limitation of Liability

TheBJJ.app is a training journal and analysis tool. It does not provide medical, coaching, or professional advice. To the maximum extent permitted by applicable law:

• The service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim

Nothing in these terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

10. Termination

You may delete your account and terminate these terms at any time from your account settings. We may terminate or suspend your account if:

• You violate these Terms of Service
• Your use poses a security risk to the service or other users
• We are required to do so by law

Upon termination, your data will be permanently deleted within 30 days, unless we are legally required to retain it.

11. Governing Law and Dispute Resolution

These terms are governed by the laws of Spain. Any disputes will be subject to the jurisdiction of the courts of Spain.

If you are a consumer in the EU, you also have the right to submit disputes to the European Online Dispute Resolution (ODR) platform:

12. Changes to Terms

We may update these Terms of Service from time to time. We will provide at least 30 days' notice of material changes by:

• Posting updated terms on this page with a new "Last Updated" date
• Notifying you by email for significant changes

Your continued use of the service after the notice period constitutes acceptance of the updated terms.

13. EU Consumer Rights

If you are a consumer in the European Union, you benefit from mandatory consumer protection laws that cannot be overridden by these terms. Nothing in these Terms of Service affects your statutory rights under:

• The Consumer Rights Directive (2011/83/EU)
• The Digital Content Directive (2019/770/EU)
• The Unfair Contract Terms Directive (93/13/EEC)
• National consumer protection laws of your country of residence

14. General

• Severability: If any provision of these terms is found invalid, the remaining provisions continue in full force
• Assignment: We may assign our rights under these terms in connection with a merger or acquisition. You may not assign your rights without our consent
• Entire Agreement: These terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and TheBJJ.app
• Language: These terms are provided in English. In the event of a conflict between translations, the English version prevails
